The new Andalusian Housing Law establishes a mandatory, public, and free Register of Real Estate Agents for those operating in the residential sector in Andalusia. Registration is required to provide real estate intermediation services to consumers legally.

When does it apply?

The law entered into force on January 24th, 2026. However, the Register of Real Estate Agents will be created and become operational within a maximum period of two years from the law’s entry into force. This means the registration requirement will be enforceable once the Register is officially launched by the Andalusian administration, no later than January 24, 2028.

Who must register?

Registration applies to all individuals and companies professionally engaged in real estate intermediation (sales, rentals, assignments) in Andalusia. It applies to both physical offices and online operations targeting Andalusian consumers.

Main registration requirements

1) Professional qualification

One of the following:

  • Official Real Estate Agent (API) title
  • University degree in relevant fields (law, economics, engineering, architecture)
  • At least four years of proven professional experience
  • Membership in a professional real estate association

2) Specific training

Recent training in real estate intermediation and, if applicable, social/affordable housing (minimum hours set by regulation).

3) Insurance and guarantees

  • Valid professional liability insurance
  • Financial guarantee or surety if handling client funds.

4) Good standing

No criminal record or disqualifications related to real estate activity.

5) Organisational requirements

  • Designate a responsible person for each office
  • Consumer information protocols and complaints handling

Registration process

Registration is completed by submitting a responsible declaration and supporting documents via the Andalusian government’s online portal. Registration is effective immediately upon submission, subject to later verification. Registration must be updated if key details change (e.g., address, insurance, and responsible persons).

Ongoing obligations after registration

Registered agents must:

  • Maintain all requirements (training, insurance, guarantees) at all times
  • Display the registration number in offices, websites, and all advertising
  • Provide clear pre-contractual information to clients and handle complaints promptly
  • Follow special rules when dealing with protected/social housing

Sanctions

Operating without registration or failing to meet requirements can result in fines, suspension, or disqualification. Fines vary depending on the severity of the infraction.
