Amongst emergency laws introduced to combat the housing shortage, additional provisions under Law 3/2024 were passed in May 2024 to regulate estate agents in the Balearic Islands.
After a six-month transitional period, the regulatory provisions came into effect in November 2024, with the aim of pushing rogue agents out of the market to improve services for buyers and sellers on the islands.
Here’s a summary of the changes in force that are designed to strengthen the property market.
New rules for Ibiza estate agents
Under the new regulations, agents dealing with Spanish real estate in the Balearics must follow the rules below. To reassure buyers that they are working with accredited professionals, estate agents in Ibiza have to:
⦿ Maintain an accessible public office
Agencies should at least have a postal address for clients to submit complaints, which means agents who only work online or over the phone must still register an office address.
⦿ Provide a registration number
All estate agents in the Balearic Islands must join the Registro Oficial de Agentes Inmobiliarios de las Islas Baleares and display their registration number on advertising materials.
Those with a university degree in law, engineering, or architecture are automatically eligible, but those without must prove they have 4+ years of professional experience or qualify through 200 hours of training on an officially recognised course.
All agents must also have liability insurance and provide a €60,000 security deposit.
⦿ Sign agency agreements
In Spain, estate agents are paid by sellers, so the property seller is the client and invoice recipient. The agent must now sign an agreement with the seller and disclose all the relevant property documents upfront.
This tackles the problem of sellers listing a property with multiple agents, who might all claim commission payments when a deal is finalised, causing disputes to arise. It also reduces the risk of deception regarding hidden defects.
With enforced registration and penalties for non-compliance, anyone dreaming of buying a house in Ibiza can have increased confidence in property transactions thanks to improved consumer protections.
